The Art of Sampling in the Aftermath of the CJEU Kraftwerk Judgment

Catch me if you can! After two decades of legal proceedings, this summer the European Court of Justice of the European Union (CJEU) finally rendered its decision on sound sampling in the infamous Kraftwerk case. It seems that there will be a bit more room for sampling against the background of the decision that sampling should be deemed an art form in itself. But under what circumstances is it possible to sample recordings without the prior consent of the master owners and what role does the human auditory sense play in this situation? And what might be the impact of the CJEU Kraftwerk judgment on the future of the electronic, bass and hip hop scenes? The panel will deal with the aftermath of this landmark case and look at the creative possibilities it opens up.
