In today’s world, an entertainer’s public persona and a brand’s carefully developed reputation in the eyes of consumers—both often developed over the course of many years—are exceedingly valuable assets. Indeed, a popular entertainer’s endorsement or a trusted brand’s logo can strongly influence a person’s willingness to purchase a product or try out a service. Accordingly, these rights, sometimes referred to as rights of publicity or personality, are legally protected in countries all over the world. But the level of protection and how it functions is by no means the same in every jurisdiction, and may even diverge dramatically in different areas within the same country. This creates a challenging and ever-changing landscape for an entertainer or brand to navigate in securing and protecting their rights.
In this Masterclass, experts from the United States, the United Kingdom, and the European Union will discuss and compare how each of their respective jurisdictions protects rights of publicity and personality (or their substantial equivalent), including by discussing what is protected and the mechanics of how an individual or brand would enforce their respective rights, and providing examples of how the laws have been applied. In addition, the panelists will discuss best practices for protecting and licensing these rights, the impact of recent legal developments, and the challenges created by evolving technology.
